Terms of Service

To maintain maximum merchant flexibility and low operating costs for local businesses:

• Inquiry & Chat Ordering: When a Buyer wishes to acquire a product or book a service, the Buyer initiates a conversation with the Store using the "Chat with Store" or "Inquire" button on the product listing or storefront.
• Mutual Agreement: All terms of the sale—including exact item availability, specifications, delivery location, shipping fees, courier timelines, and payment method—are agreed upon directly between the Buyer and the Store via the chat thread.
• Payment Methods: Transactions are settled directly between Buyer and Store (for example: Cash on Delivery upon physical inspection, merchant-provided point-of-sale links, or in-person store collection). W Buys does not act as an escrow agent, does not collect payment card information, and charges zero processing fees to the Buyer.
• Commercial Contract: The contract for purchase and sale is formed solely and directly between the Buyer and the Store. W Buys is not a party to this contract and bears no liability for performance, non-delivery, or delays.

Every Store registered on W Buys represents, warrants, and agrees that:

• Legitimacy & Licensure: The Store possesses all necessary trade licenses, permits, and governmental authorizations required to sell products or offer services in their applicable territory (including compliance with United Arab Emirates and regional commercial laws).
• Authentic Merchandise: All offered items are genuine, original, and legally acquired. The sale of counterfeit, stolen, grey-market, or replica merchandise is strictly prohibited and results in immediate permanent termination and reporting to competent authorities.
• Accurate Listings: Product descriptions, prices, stock availability, and imagery must be accurate, transparent, and not misleading.
• Customer Service & Fulfillment: Stores are responsible for responding respectfully to customer inquiries, dispatching agreed orders promptly, and clearly stating their return and exchange policies to Buyers in chat prior to fulfillment.

As a Buyer on W Buys, you agree to:

• Provide truthful, accurate, and current contact and delivery information when agreeing to an order with a merchant.
• Honor orders agreed under Cash on Delivery (COD). Placing fraudulent orders, deliberately refusing deliveries without valid inspection cause, or repeatedly failing to receive agreed parcels harms local businesses and may lead to account suspension.
• Inspect merchandise upon delivery or collection, ensuring it matches the specifications agreed upon in the chat conversation with the Store.

The following categories of products and behaviors are strictly forbidden on W Buys:

THE PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL W BUYS, ITS FOUNDERS, DIRECTORS, AFFILIATES, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to access the Platform;
• The quality, condition, safety, or legality of any products or services acquired through independent merchant stores via chat;
• Any actions, omissions, or statements made by any third party, Store, or Buyer on the Platform.
